Power of Attorney. Is it as simple as filling in a form from a post office? The answer is no! Here’s why!

A Power of Attorney is a legal document giving your appointed attorney power to handle your financial affairs. This can include selling or transferring any real property or investments you own and managing your finances.

There are many different aspects that are not often thought about when making a Power of Attorney. Whilst your attorney does have obligations to act in your best interests, this does not always happen!

If you watched Anabel and Simon’s story, you will see that Simon was lucky that Anabel had come to Wollerman Shacklock Lawyers to have a properly prepared Power of Attorney document, which meant that Simon was able to successfully have his sister removed as joint attorney and have the transfer of property reversed.

If Anabel did not have a properly prepared Power of Attorney, this would have resulted in Simon having to issue more lengthy and costly proceedings against his sister to have the transfer of property reversed and remove his sister as attorney, or to make application to become Anabel’s administrator in the event the Power of Attorney document was rendered invalid.
